Most people are often confused as to what the mediator’s role is. Once understood, the definition is not as intimidating.

  • it is a way to assist the courts
  • a neutral third party who helps resolve conflicts
  • people generally go through mediation during most lawsuits
  • it is actually encouraged by American courts

Not just anyone can be a mediator, some states require them to have finished a degree in law.

  • Professional mediators undergo a special training which equips them with skill and knowledge to facilitate mediations amidst a possibly tense situation.
  • Mediation is a natural extension of legal practice.
  • Legal experience is necessary to mediate complex disputes.

During mediation, those involved can get beyond the confines of the law. While legal experience has it’s advantates, it also has it’s disadvantages. Things that a person needs to consider when choosing a mediator.
